Privacy notice
We ask for a great deal — an identity number, banking details, the names of your family. This explains what we do with it, who else sees it, and what you can require of us.

2What we collect
When you apply for cover, we collect:
- Your identity number, and the identity or birth-certificate numbers of everyone you insure
- Names, date of birth, gender and citizenship — most of which your identity number itself tells us
- Your address, telephone number and email address
- Your banking details and debit order mandate
- Your beneficiary’s details
- Copies of identity documents, birth certificates or passports, which the insurer requires
When we conduct a funeral, we also hold information about the deceased and about the family member arranging it — including cause and date of death, which is special personal information under the Act and is handled accordingly.
3Why we collect it, and on what basis
We collect it because we cannot otherwise do what you have asked us to do. Specifically:
- To conclude and administer your policy — necessary to perform our contract with you
- To collect your premium by debit order
- To pay a claim and to arrange the funeral
- Because the law requires it — identification under FICA, and the records the insurer and the regulator require us to keep
- To contact you about your policy — which is service, not marketing
4Marketing — only if you say yes
We will not send you marketing by email, SMS or WhatsApp unless you have specifically agreed to it. Agreeing is a separate choice; it is never bundled into applying for cover, and there is never a pre-ticked box.
You may tell us to stop at any time, free of charge, by any means you like — replying to the message, WhatsApp, email, telephone, or a letter. We will act on it and we will not ask you to justify it.
Messages about your own policy — a premium that did not go off, a document we need, a claim — are not marketing and will continue, because they are part of the service you have asked for.
5Who else sees it
Your information is shared with those who need it to give you what you bought:
- AMOR BROKERS (FSP 52097), which administers the policy
- Safrican Insurance Company Limited, the insurer, which carries the risk and pays the claim
- Netcash, which collects your premium by debit order under the mandate you sign
- Our own staff and appointed agents, limited to what their role requires
- Home Affairs, a cemetery or crematorium, and the authorities involved in registering a death, where we are arranging a funeral
One further party, to measure whether our advertising works:
- Meta, which runs Facebook and Instagram. Our public website uses the Meta Pixel, which records which pages are visited and whether an application was started or submitted. When you apply, we also send Meta your email address and cellphone number in scrambled (hashed) form, and later whether your first premium was collected, so that we can tell which advertisement brought you to us.
We never send Meta your identity number, date of birth, the people you insure, your beneficiary or your banking details. The Pixel does not run on your policy page or in our back office. You can limit this through the ad settings in Facebook and Instagram, or by blocking third-party cookies in your browser.
We do not sell your information, and we do not share it for anyone else’s marketing.
6Where it is kept
Our systems are hosted with reputable providers, and some of them store data outside South Africa. Where that happens, we satisfy ourselves that the country or the provider offers protection comparable to POPIA, as the Act requires.
7How we protect it, and what we cannot promise
Access is restricted by role, so staff see only what their work requires. Documents you upload are held in private storage that is not publicly reachable. Connections to this site are encrypted.
We will not tell you your information is perfectly safe, because nobody can honestly say that. What we undertake is to take the measures the Act requires, and to tell you and the Information Regulator if your information is ever compromised, as we are obliged to.
8How long we keep it
For as long as your policy is in force, and after it ends for as long as the law requires us to keep the record — generally five years from the end of the relationship or the conclusion of a claim, and longer where another law or a dispute requires it. After that it is destroyed or de-identified.
9What you may require of us
You are entitled to:
- Ask what information we hold about you, and be given a copy
- Have anything inaccurate corrected, or anything we should not be holding deleted
- Object to how we are using it
- Withdraw a consent you gave, without that affecting what was lawful before you withdrew it
- Complain to us, and to the Information Regulator
Write to info@samwill.co.za or telephone 021 203 5379. Our PAIA manual sets out the formal request procedure.
10Complaining to the Regulator
If you are not satisfied with how we have handled your information, you may complain directly to the Information Regulator (South Africa).
