2The guide published by the Information Regulator
The Regulator has published a guide on how to use the Act. It is available in all official languages, free, from the Regulator at inforegulator.org.za or by writing to inforeg@justice.gov.za.
3Records we hold
Grouped by subject, so you can see what might concern you:
- Policyholders — applications, policy schedules, insured lives, beneficiaries, banking mandates, premium and claim history, identity documents
- Funerals — arrangement records, the deceased’s details, statutory documents such as the BI-1663 and burial orders, invoices
- Staff and agents — employment and appointment records, commission records
- Company — registration and statutory records, financial and tax records, insurance, licences and professional memberships
- Suppliers — contracts and correspondence
Some records are also held by AMOR BROKERS as the administrator of the cover and by Safrican Insurance Company Limited as insurer. Where a record is theirs rather than ours, we will tell you so and direct you to them.
4Records available without a formal request
You do not need to use the Act to get your own policy documents, premium history or an invoice for a funeral we conducted. Telephone 021 203 5379 or write to info@samwill.co.za and we will send them.
5How to make a formal request
- Use the prescribed request form, available from the Regulator’s website
- Send it to the Information Officer at the address or email above
- Identify the record clearly, and tell us which right you are seeking to exercise or protect
- Give us an address or email for our reply, and proof of identity
We will decide within 30 days and tell you in writing. That period may be extended once, and we will tell you if it is. If we refuse, we will give reasons and explain what you may do about it.
6Fees
There is no fee to request your own personal information. For other records the prescribed request and access fees apply, and we will tell you what they are before doing the work.
7If we refuse
You may complain to the Information Regulator, or apply to a court. The Regulator’s details are on our privacy notice.
